Present Terms and Conditions (hereinafter referred to as “Terms”, “Terms and Conditions”) between You and Exomoon:

Exomoon SIA a company incorporated in the Republic of Latvia under registration number 45403059075, with legal address at Dzirnavu iela 83-34, Riga, LV-1011, Latvia. Exomoon SIA is a Virtual Asset Service Provider, authorised and regulated by the State Revenue Service of Latvia (SRS). Registered in the goAML system under the reference number 1784 within the Financial Intelligence Unit of Latvia. This authorisation allows Exomoon SIA to provide a virtual currency exchange service, facilitating the exchange between virtual currencies and fiat currencies, as well as between different virtual currencies.

Please be aware that this is the only official website of Exomoon. By visiting, using, or browsing this site, you confirm that you have read, understood, and agreed to follow all the rules and information included in these Terms. Your ability to use the Service depends on whether you accept and follow these Terms. Also, you agree to follow any additional rules that might apply to you when you use this website, whether they're on this site or in a separate agreement with Exomoon.

Exomoon can change these rules whenever it wants and will put the new rules on this website. If you don't accept these rules, you should leave the website now. Remember to check the rules periodically for any updates. If you keep using this website after we've changed the rules, it means you agree to the new rules.

1. Eligibility Requirements

• you represent and warrant that you are at least 18 years old (this website is only intended for use by anyone of legal age);
• you have not been previously banned or suspended from using our Service;
• you have the legal capacity to enter into this agreement and will not violate any other agreements to which you are a party.
• you are not subject to the control of any citizen or resident of prohibited territories;
• you will not use our Service if it violates any laws or regulations in your country.
• you are using our services on your own initiative and are aware of what you are doing

If you are entering into these Terms on behalf of a legal person, you represent and warrant that you have all necessary rights and authority to act on behalf of such legal entity.


2. Non-Serviced Countries and Territories

At present, Exomoon does not provide Service to the following countries and regions. This list is subject to change: Afghanistan, Albania, Algeria, Bangladesh, Bahamas, Benin, Bolivia, Cameroon, Central African Republic, Chad, China, Democratic Republic of the Congo, Cote d'Ivoire, Cuba, Democratic People's Republic of Korea, Ecuador, Egypt, Eritrea, Ghana, Guinea, Guinea-Bissau, Haiti, Iran, Iraq, Japan, Kuwait, Lebanon, Liberia, Libya, Macedonia, Mali, Morocco, Myanmar, Nauru, Nepal, Nicaragua, Pakistan, Palestine, Panama, Qatar, Russian Federation, Somalia, South Sudan, Sudan, Syrian Arab Republic, Togo, Trinidad and Tobago, Uganda, Venezuela, Yemen, Zimbabwe, Abkhazia, Azores, Crimea, Donetsk Oblast (Ukraine), Gaza Strip, Kashmir, Kherson, Kosovo, Luhansk Oblast (Ukraine), Nagorno Karabakh, Northern Cyprus, South Ossetia, Zaporizhzhia, West Bank, Pridnestrovian Moldavian Republic, United States of America.

2.1. Sanctions

Sanctions are restrictive measures imposed by international public law and approved by international organisations and/or countries regarding countries, specific subjects of sanctions (terrorists, persons accused of military and political crime, extremist organisations, etc.), or activities.
The company strictly adheres to national and international sanctions. We ensure that our services and customer exchanges comply with the laws and regulations of the Republic of Latvia and the European Union, as well as with sanctions imposed by the European Union, the United Nations, and the United States.
In connection with the situation that has arisen around Russia and Ukraine, extensive sanctions have been imposed against both the Russian Federation and the Republic of Belarus, some of their citizens, and enterprises.
The company strongly advises verifying information about sanctions and any updates in this area before initiating any cooperation or making payments. The complete list of sanctions can be publicly accessed on the EU and OFAC homepages.

3. Payments

Please note that we don't allow payments from other people's credit cards, bank accounts, or payment system accounts. The name on the card or account must be the same as the name on your profile in the system for the payment to go through.

4. Service

Exomoon uses Peer-to-Peer (P2P) exchange platforms for buying and selling Virtual currencies, such as Bitcoin, Ethereum, USDT and others.
Please be aware that Virtual currencies are decentralised and as such are not regulated and are subject to large fluctuations in value.

5. Extra fees

You agree to pay Exomoon the fees for non-compliance with the procedure and our terms, which we may change from time to time. Changes to the Extra Fee are effective as of the effective date indicated in the Terms updates.

The Extra Fees related to buying of Virtual currency are as follows:

If funds are sent from a bank account that does not belong to you, we will deduct 2% of the payment amount, but not less than 10 EUR, and make a reverse transfer.

You authorise us to charge or deduct any applicable Fees owed in connection with your payment under the Service and these Terms.

6. Transaction processing/Refunds

We aim to complete all transactions within 30 minutes of receiving the customer's payment. However, if we receive payment outside of our business hours (weekdays between 9:00 and 18:00 EET/EEST), the transaction will be processed during the following business day's hours.

6.1. Please be aware that in certain cases, as determined by our internal company policy, Exomoon may require additional information or documents to complete a transaction. These must be provided within 24 hours of receiving the request.
The requested documents are typically reviewed within 24 hours of submission, excluding weekends. If the documents or information provided do not fully meet the requirements, you'll receive another request. In this case, the review period will be extended for another 24 hours, excluding weekends, from the time the documents or information were last provided.
In some circumstances, such as when there's a large number of documents to review or transactions to process, or other factors requiring a more thorough examination, the review may take longer.

6.2. If your transaction hasn't been processed and you haven't received a request for documents or information within 72 hours of making the payment, you can request a reversal of the payment, and you'll receive a full refund. Normally, refund requests are processed within 24 hours, excluding weekends, and the refund is issued using the same payment method used for the original transaction. However, the time it takes for the refunded funds to be credited to your account or card depends on the payment method and the processing time of the specific payment service provider.

6.3. Please be aware that Exomoon SIA is not a payment service provider (PSP) and does not hold a financial license. Therefore, the long-term storage of client funds in our service is not allowed.

In situations where a transaction (exchange) cannot be processed, as outlined in clauses 2, 8, 11, and 12 of this Agreement, and the return of funds is not possible within 60 days due to:

• Failure of the customer to respond to emails or phone calls.
• The client not providing additional information for the return of cryptocurrency.

After the mentioned period expires, Exomoon SIA applies a storage fee of 50 EUR or equivalent in cryptocurrency for each subsequent or overdue day. This fee covers the costs associated with maintaining Exomoon's assets, its operators, affiliates, or any third party, and is deducted directly from the client's funds. Clients agree to this deduction from their assets.

In this scenario, the client's funds held in Exomoon's balance become an interest-free deposit.

7. Verification process

When you initiate an exchange request, you agree to provide the requested personal information for identity verification purposes. This is done to prevent activities related to money laundering, terrorism financing, fraud, or any other financial crime, and to maintain a record of such information. Before proceeding with the exchange, you'll need to complete certain verification procedures. The information we may request includes your name, address, phone number, email address, proof of address, and bank account details, among others. By providing us with this information, you confirm its accuracy and authenticity.

You authorize us to conduct inquiries that we consider necessary to verify your identity or protect both you and us against fraud or other financial crimes. Based on the results of these inquiries, we may take appropriate action. During these inquiries, you acknowledge and agree that your personal information may be disclosed to credit or payment institutions and law enforcement agencies upon relevant official requests.

To complete your identity verification, you should visit the verification page, complete the online questionnaires, and upload the required documents, including a copy of your valid international passport or ID, and undergo a liveness check using a video camera.

8. Prohibited Actions & Termination of Service

Customers of this website are not allowed to engage in the following actions, which include those prohibited by other sections of these Terms and Conditions:

• Actions that may violate the copyrights, privacy, property, or other rights of other users, third parties, Exomoon, or its partners.
• Actions that may cause harm, financial loss, or other damages to other users of this website.
• Actions that may be offensive to public order and morals, or violate laws, regulations, and ordinances.
• Providing false information when using Exomoon for exchanges or other purposes.
• Illegitimate use of email addresses, passwords, or other personal information.
• Any other actions that may disrupt Exomoon's services.

Exomoon reserves the right to end any existing business relationship between Exomoon and Customer, if:

• The Customer fails to provide or provides false, incorrect, or incomplete information about their identity or the origin of their funds.
• There is suspicion that the Customer is involved in money laundering, terrorist financing, or fraudulent activities.
• Exomoon has reason to believe that the Customer is using or attempting to use the account for unlawful activities, including money laundering, terrorist financing, or circumventing sanctions.
• Exomoon receives information about the Customer's reputation that could negatively impact Exomoon's operations.
• A supervisory authority, government institution, international organization, or bank partner requests termination of the business relationship with the Customer.
• The Customer fails to provide requested information or comply with applicable laws and regulations.
• The Customer's internal control system does not comply with anti-money laundering and terrorist financing prevention laws.
• Other cases specified in Exomoon's internal anti-money laundering procedures.

9. Changes

Exomoon reserves the right to change these Terms and Conditions at any time without prior notice. In the event that any changes are made, the updated Terms and Conditions shall be posted on this website immediately. Please check the latest information posted to stay informed about any changes.

10. Limitation of loss

Exomoon exclusively offers exchange services and does not provide cryptocurrency storage (wallet creation) or brokerage services to customers. In no event shall we be liable for the following types of loss or damage under these Terms or otherwise:

• Loss of profits, expected revenue, or gains, including trading profits and hypothetical trading losses.
• Damage to reputation or goodwill, loss of business or opportunities, customers or contracts, waste of overheads, management or staff time, or any other revenue or savings loss.
• Damage to hardware, software, or data, including data corruption, inaccuracies, defects, or omissions in cryptocurrency price data, transmission errors or delays, or data interruptions.
• Loss or damage not directly caused by our breach of these Terms, or loss exceeding the direct result of our breach (whether or not provable).
• Loss due to circumstances beyond our control, such as war, political regime changes, or third-party actions.

11. Assumption of risk

Cryptocurrency involves significant risks. Before buying cryptocurrency, you should carefully consider if it's suitable for you:

• You acknowledge and accept the risks linked with cryptocurrency wallets, such as equipment failure, software glitches, internet interruptions, malware, and unauthorized access by third parties. Exomoon isn't responsible for any communication failures, errors, or delays you encounter.
• We aren't liable for any losses, damages, or claims resulting from corrupted wallets, incorrect wallet addresses, viruses, or attacks by third parties.
• While using our Service, you're responsible for your cryptocurrency exchange account wallet. It's up to you to safeguard your wallet from unauthorized access and secure your password and personal data.
• In case of a refund, all commission costs for electronic money transfer are deducted from the funds received from you.
• Exomoon reserves the right to stop the sale of electronic currencies until the user provides identity documents for verification.

12. Third-party systems

The end user must agree to the following terms:

• Exomoon uses third-party services, including their affiliates, to enable you to deposit money and make payments on partner websites using your credit card if available and applicable. This service does not involve depositing cryptocurrency into your account.
• Exomoon may share your personal information with the third-party service provider for the purpose of providing the service, which involves making payments on partner websites using your credit card. This sharing of personal information occurs when you choose to make monetary payments using the third-party service provider's services. Personal information includes details that identify you, such as your email address, password, country, city, information from social websites, or any other identifying information you provide while using our website.
• Additionally, non-personal information provided by you through your use of our website's service may be transferred to the third-party service provider. This transfer allows the third-party service provider to conduct preliminary assessments of non-personal information to determine your eligibility to use their services. This includes transaction history provided without identifying information, solely for conducting preliminary assessments.
• By accepting these terms, you confirm that all information you provide to us is true and accurate. Providing false or fraudulent information, or misusing the service, is prohibited.
• You are not legally obligated to provide personal information to the partner or the third-party service provider. You acknowledge and agree that you are providing personal information voluntarily for the purpose of receiving the services.
• You are fully responsible for determining any taxes applicable to the virtual currency exchange transactions you complete using the service. You must report and pay the correct taxes to the appropriate revenue authority. Exomoon is not responsible for determining whether taxes apply to your virtual currency exchange transactions.

13. Links to other websites

The Exomoon website may have links to other Exomoon webpages and resources. However, these links don't mean we endorse any third-party resources or their content. They also don't mean that Exomoon is affiliated with or authorized to use any trademark, logo, or copyright symbol of those third parties. If you have concerns about any linked website, you should contact the website administrator or webmaster of that linked website.

Exomoon doesn't vouch for the accuracy or reliability of any advice, opinion, statement, or information provided on linked websites. You acknowledge that relying on any information from linked websites is at your own risk.

14. Privacy Policy

15. Force majeure

Exomoon is responsible for handling the Customer's orders carefully and protecting their interests to the extent required by law and reasonably possible.

Exomoon won't be held responsible if it can't fulfill its obligations due to events beyond its control, such as major unforeseen circumstances (like changes in laws or regulations, natural disasters, wars, strikes, communication failures, or system breakdowns).

16. Dispute resolution

If you're not happy with our service based on these Terms and Conditions, you can file a complaint with us in writing via email at info@exomoon.lv. We'll do our best to address your complaint promptly and send you a final response within one month of receiving it. If you don't receive our final response or if you're still unsatisfied, you have the option to take legal action before the competent courts of the Republic of Latvia.

Any disagreements related to these Terms or the relationship between the Service and the Customer will be resolved through negotiation between the involved parties.

All regulations are subject to the laws of the Republic of Latvia.

17. Form of the Terms

Both the Customer and Exomoon acknowledge that these Terms, in digital form, hold the same legal weight as an agreement executed in written form.
